Довгострокова сталість космічної діяльності: нові виклики перед міжнародним і національним космічним правом

Анотація: Висвітлено результати дослідження правових проблем, які є актуальними для забезпечення довгострокової сталості космічної діяльності, курс на яку як дороговказний проголошено ООН. Виокремлено правовідносини, які з одного боку дозволяють пожвавити комерційну складову космічної галузі вітчизняної економіки, а з іншого - сприяють утвердженню відповідальної сталої поведінки усіх суб’єктів космічної діяльності в загальнопланетарному масштабі. Під таким кутом зору розглянуто специфічні проблеми державно-приватного партнерства в космічній галузі, висунуто пропозиції щодо правової моделі регулювання дистанційного зондування Землі, наголошено на викликах перед міжнародним і національним правом у зв’язку з кіберзагрозами космічній діяльності, в тому числі й задопомогою використання блокчейн технології, проаналізовано міжнародно-правові проблеми регулювання видобування ресурсів космосу під кутом зору забезпечення сталості цієї діяльності, наголошено на необхідності напрацювання правових механізмів, вироблення норм та принципів відповідальної поведінки людини в космосі.
У результаті дослідження було запропоновано: 1) правові засоби лібералізації участі державних підприємств як суб’єктів, а не об’єктів відносин державно-приватного партнерствам 2) модель врегулювання відносин із забезпечення України даними ДЗЗ, в тому числі й шляхом публічних закупівель Центром управління і випробовування космічних засобів, 3) міжнародно-правові та національно-правові механізми боротьби із кіберзагрозами космічній діяльності,4) правові інститути, які слід розвивати для унормування діяльності із видобування космічних ресурсів, а також 5) правила забезпечення відповідальної космічної діяльності.
